§ 1. General Provisions

  1. The online store World Retro, available at https://world-retro.com/ (the “Store”), is operated by Paul Jago.
  2.  (the “Seller”) NIP [Tax ID]: 726 271 94 05, REGON: 544 292 620.
  3. These Terms and Conditions (the “Terms”) are addressed to both Consumers and Businesses using the Store and set out the rules for using the online Store and for concluding distance Sales Agreements with the Customer through the Store.
  4. Products offered in the Store are made to the Customer’s individual order and are not supplied from stock. The order fulfilment time is set out in § 8 of these Terms.

§ 2. Definitions

  1. Consumer – a natural person entering into an agreement with the Seller for purposes not directly related to their business or professional activity.
  2. Customer – any entity making purchases through the Store.
  3. Store – the online store operated by the Seller at https://world-retro.com/.
  4. Product – a movable item available in the Store, made to order in accordance with the parameters (including size) specified by the Customer.
  5. Sales Agreement – a sales agreement for a Product concluded between the Customer and the Seller through the Store.

§ 4. Size and Customer Responsibility for Size Selection

  1. The Customer is solely responsible for selecting the correct Product size when placing an order.
  2. The Seller shall not be liable for an incorrect size selected by the Customer. The Customer acknowledges that orders cannot be cancelled, exchanged or refunded solely because an incorrect size was chosen.
  3. The above provision does not exclude the Seller’s liability for defects in the Product unrelated to the Customer’s size selection (for example, where the Product was manufactured inconsistently with the order placed).

§ 5. Placing Orders

  1. Orders are placed through the order form available in the Store.
  2. To place an order, the Customer selects a Product, specifies its parameters including size and then confirms the order.
  3. After the order is placed, the Seller verifies the project details (including the correctness of any print/personalisation data) before starting fulfilment.

§ 6. Payment

  1. Fulfilment of an order is conditional on payment in full in advance, by bank transfer or by card.
  2. Order fulfilment begins once payment has been credited to the Seller’s bank account and the Seller has verified the project details.

§ 7. Order Fulfilment and Delivery

  1. The standard order fulfilment period is up to four (4) weeks from the date full payment is received and all order details have been confirmed. This timeframe reflects the fact that all Products are individually manufactured to order, including production, quality control, packaging and preparation for worldwide delivery. As Products are not held in stock, production begins only after the order has been confirmed and paid in full. All orders are shipped worldwide.
  2. Delivery of the Product is carried out worldwide, and its cost is included in the price of the Product.
  3. Detailed information about the chosen carrier and the estimated delivery time is provided to the Customer electronically once order fulfilment has begun.

§ 8. Complaints, Non-Delivery and Product Defects

  1. The Customer has the right to file a complaint if a Product has not been delivered or is defective.
  2. Complaints should be submitted to the following e-mail address: contact@football-heritage.world describing the order and the issue identified.
  3. The Seller will handle the complaint within 14 days of its receipt.
  4. If a complaint regarding non-delivery or a defective Product is upheld, the Customer is entitled to an immediate refund of the full amount by bank transfer.
  5. Alternatively, instead of a refund, the Customer may, at their request, choose to receive a second (replacement/corrective) shirt at no additional cost.

§ 9. Right of Withdrawal from the Sales Agreement

  1. A Customer who is a Consumer has the right to withdraw from the Sales Agreement within 14 calendar days without giving any reason, in accordance with applicable consumer protection law.
  2. The right of withdrawal referred to in paragraph 1 does not apply to Products made to the Customer’s specifications or clearly personalised (e.g. Products bearing an individual print, name, number, or other graphic personalisation), in accordance with the applicable consumer protection exemption for custom-made or personalised goods.
  3. If standard-version Products (without individual personalisation) are also intended to be fully excluded from the right of withdrawal, this requires separate legal review. The Customer’s selection of a Product size alone is not, by itself, a sufficient basis for such an exclusion.
  4. The withdrawal period begins on the day the Customer, or a third party indicated by the Customer, takes possession of the Product.
  5. In the event of a valid withdrawal, the refund will be made promptly, no later than within 14 days, using the same payment method used by the Customer, unless the Customer expressly agrees to a different method that does not involve any additional cost.

§ 10. Governing Law and Jurisdiction

  1. Sales Agreements concluded through the Store with a Customer whose order is fulfilled by the entity registered in England and Wales are governed by the law of England and Wales, and disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, having regard to the Seller’s registered address.
  2. Sales Agreements concluded through the Store with a Customer whose order is fulfilled by the entity registered in Poland are governed by Polish law, and disputes shall be subject to the jurisdiction of the courts having regard to the Seller’s registered address in Poland.
  3.  Sales Agreements concluded through the Store are fulfilled by Paul Jago, a company registered in Poland under company number 7262719405. 
  4. For Consumers residing in the European Union, the above choice of law does not deprive them of the protection afforded by mandatory provisions of the law of their country of habitual residence, where those provisions are more favourable to them.

§ 11. Personal Data

  1. The controller of Customers’ personal data is the Seller.

§ 12. Final Provisions

  1. Agreements concluded through the Store are concluded in English.
  2. The Seller reserves the right to amend these Terms for valid reasons (e.g. changes in law, changes to payment or delivery methods). Customers will be notified of any changes with reasonable advance notice.
  3. In matters not regulated by these Terms, the governing law specified in § 10 shall apply.
